By agreeing to the Herman & Wallace Terms and Conditions for purchasing and/or Pre-Funding a product, I acknowledge, and agree to, the following Terms and Conditions:

Terms and Conditions applicable to Product Pre-Funding

1. That the product in development that I am pre-funding has yet to be completed, and I will receive no downloadable files upon payment.

2. In the event that Herman & Wallace fields a minimum number of pre-funders for this product by the end of this product's trial period: Herman & Wallace will develop this product to completion; and Upon completion of the product component files to the level of quality consistent with the Herman & Wallace brand, will send the files via email attachment comprising this product to all the product pre-funders at no additional cost to each product pre-funder.

3. In the event that Herman & Wallace does not field a minimum number of pre-funders for this product by the end of this product's trial period: Herman & Wallace will not develop this product to completion; and Will refund to each pre-funder, via reversal of credit card charge, 100% of the amount paid to pre-fund this product.

Terms and Conditions applicable to products available for immediate download upon purchase, as well as, pre-funded products sent to purchasers upon completion of development

1. Products developed and distributed by the Herman & Wallace Pelvic Rehabilitation Institute (hereafter "Herman & Wallace") are the sole intellectual property of Herman & Wallace, and shall not be redistributed or sold to individuals who have not purchased them directly from Herman & Wallace.

2. Products are dispensed digitally, and it is the responsibility of the purchaser to have access to a functional electronic mailing address. Products are designed for use with Microsoft Office(R), and Herman & Wallace is not responsible for complications arising from software compatability, service interruptions, or other complications associated with online distribution.

3. Products purchased for use within a clinic may be shared among therapists who share similar resources on a daily basis; products may not be shared inter-departmentally or with any organization other than the original purchaser.

4. Purchases of a product concept ("Pre-Fund") prior to that product's development are subject to the following terms:

a. Herman & Wallace is not obligated to develop any product that does not meet tests of market demand as set forth hereafter;

b. Only products concepts which are purchased by greater than 9 customers will be developed. Product concepts which do not meet this threshold within 30 days will not be developed.

c. Customers who purchase a product concept which is not developed will receive a full refund at the time that Herman & Wallace determines a product concept has failed.

d. Customers who purchase a product concept which is developed will receive an early-edition draft of that product before the final version is published. Feedback will be solicited from said customers for a period of 15 business days. Herman & Wallace makes no guarantee that customer recommendations will be incorporated into the final edition of any product.
